Chapter XXXII 

Method of Appointment and Qualifications of Teachers and Non - Teaching Staff in Aided Higher Secondary Schools


3. The Kerala Aided Higher Secondary Education Service:- 

The service of every aided Higher Secondary School shall consist of all or any of the following categories of posts as the Director may sanction.

Category 1- Principal

Category 2 - Higher Secondary School Teacher

Category 3 - Higher Secondary School Teacher (Junior)

Category 4 - Librarian Grade III

Category 5 - Librarian Grade IV

Category 6 - Laboratory Assistant

Category 7- Lower Division Clerk

Category 8 - Part Time Menial


4. Method of Appointment:- Appointment to the various categories specified in Column (2) of the Table below shall be made by the method of appointment specified against each in column (3) thereof-

6. Qualifications:- No person shall be eligible for appointment to the category in column (2) in the table below under the method specified in column (3) unless he possesses the Qualificationsprescribed in the corresponding entry in column (4) there of.

The Committee submitted the first part of its report to Chief Minister Pinarayi Vijayan on January 24, 2019.



Rashtriya Madhyamik Shiksha Abhiyan (RMSA)

The Rashtriya Madhyamik Shiksha Abhiyan (RMSA) is a flagship scheme of Government of India, launched in March, 2009, to enhance access to secondary education and improve its quality.


  • Library will be established and run in a room of adequate size as per the norms fixed by the State Government or Raja Ram Mohan Roy Library Foundation, the nodal agency of Govt. of India to support public library services and systems. 
  • Should involve elements of community contribution. 
  • Grants will be available only for those schools which have existing buildings of their own 
  • Cost of construction will include furniture, Almirah, racks, fixtures, fittings, circulation area (verandah) etc.
  • Community should be approached to provide books and furniture etc. in the library.


  • Purchase of books with due reference to the lists of books recommended by the KVS (or) 
  • List recommended by the State Governments (or) 
  • Rs. 10,000 per annum or the actual expenditure, whichever is less. 
  • Text Books and Reference Books for teachers should also be included. 
  • (or) as per the scheme formulated by Raja Ram Mohan Roy Library Foundation, the nodal agency of Govt. of India to support public library services and systems.

5.5. Learning Resources
5.5.1 Laboratories and Equipments 
The main reasons for failure in exams of a large number of students are their limited understanding of concepts in Mathematics & Science and their weakness in English. NCF-2005 addresses this issue. The National Focus Group on “Teaching of Science” suggested prevention of marginalisation of experiments in school science curriculum. Investment in this regard is needed for improving school Libraries, Laboratories and Workshops to promote experimental culture while reducing the importance of external examinations.

5.7 Learning Resource Centres (LRC)
5.7.1 In conformity with the advocacy in the National Curriculum Framework (NCF-2005) about curriculum enrichment for overall development of children rather than remaining textbook centric, and ensuring that learning is shifted from rote memorization and also in order to ensure quality in Secondary and Higher Secondary Education, all schools need to be equipped with Learning Resource Centres (LRC) with following inputs.

Provision for ICT support
Link with EDUSAT

5.7.2 The ICT Resource Room and Library of the school may be housed in one big room or these may be housed in two adjacent rooms. All Library operations from accession to issue of books will be computerized. The provision of integrated Learning Resource Centre (LRC) will facilitate such activities. These resources will be instrumental in raising the knowledge and achievement levels of students.

5.7.3 There is need of a regular librarian cum computer instructor to look after the affairs of library as well as ICT activities. The scheme also provides for physical and financial norms for construction of library, if it was already not provided in the school and purchase of books, periodicals, newspapers, magazines etc. The norms have been discussed in a separate chapter.


According to G.O. (Ms) No. 220/2015/G.Edn. dated 17/08/ 2015, General Education - Higher Secondary Education - Aided --- Creation of posts of Lower Division Clerk, Full Time/Part Time Menial and Librarian Grade IV in Higher Secondary Schools - Scheme approved - Common Judgment dated 05.09.2013 inWP (C) No. 29618/2005, 5835/2013, 7385/2013 and 7881/2013 - Complied with - Orders issued

Sri. S. Syamkumar & Others; the Manager, MM Higher Secondary School, EastKallada, Kollain District; the Manager, SVM Higher Secondary School, Vendar (PO), Kottarakkara, Kollam and Kerala Aided School Non-Teaching Staff Association & others have filed Writ Petitions No.29618/2005, 5835/2013, 7385/2013 and 7881/2013respectively before the Hon'ble High Court of Kerala with a prayer to direct the Government to create posts of Menial Workers, Clerks and Librarian in the Higher Secondary Schools in the State of Kerala.

2) The Hon'ble High Court as per the Judgment read as 4th paper above directed Government to take a pragmatic view of the matter and to prepare a scheme in consultation with the Finance Department and place it before the Cabinet for approval within six months from the date of receipt of a copy of the Judgment.

3) The Director of Higher Secondary Education as per the letters read as 5 paper above proposed a scheme to Government for creating the posts of Lower Division Clerk, Full/Part Time Menial and Librarian Grade IV in Higher Secondary Schools in Kerala.He has reported that at present there are a total of 1639 higher secondary schools functioning in aided and Government sector. Out of this 816 are in government sector and 823 are in aided sector.

4) As per the Government Order read as 1st paper above, Government issued Special Rules for the Higher Secondary Education Department. As per this Special Rules, 8 categories of posts are necessary for the smooth functioning of the HigherSecondary Schools viz, Principal, HSST, HSST (Jr), Librarian Grade III, Librarian GradeIV, Laboratory Assistant, Lower Division Clerk and Part Time Menial.

6) Government have examined the matter in detail with reference to relevant rules and orders and are pleased to approve the scheme detailed below for the creation of posts of Lower Division Clerk, Full Time/Part Time Menial and Librarian Grade IV in Government/Aided Higher Secondary Schools.

i. One post each of Lower Division Clerk and Full Time/Part Time Menial for every Higher Secondary School will be created in 1st phase.

ii. One post of Librarian Grade IV will be created in Higher Secondary Schools which are having a library as per the criteria of the State Library Council consisting of at least ten thousand books in 2nd phase.

iii. The appointment to the post of Lower Division Clerk and Librarian will be done as stipulated in the concerned Special Rules and the Part Time Menials in Government Higher Secondary Schools on daily wages will be recruited through Employment Exchange.

7) The Director, Higher Secondary Education is hereby directed to furnish separate proposal on item No.i, ii, iii above for the creation of Lower Division Clerk, Librarian Grade IV and Full Time/Part Time Menials in Government/Aided Higher Secondary Schools.

For plus two students, librarians with 10th pass.

Qualifications of the libraries and librarians are prescribed by State Library Council, a mere political group, which is a special purpose vehicle for carrying out only political agendas, that has no professional representation of any kind.

this Court had taken note of the respective contentions and had observed that when a statute is framed and the posts had been specifically mentioned in the statute, the Government and its authorities were expected to act within a reasonable time and ensure that such posts are sanctioned without delay. The embarrassment created in not taking further steps in the matter despite lapse of a substantially long period has also been expressed by this Court.

The main contention urged by the learned Government Pleader while impugning the judgment of the learned Single Judge is that concurrence is required from the Finance Department and hence the delay. 

It is apparent that the matter had been pending for quite a long time. There is absolutely no merit in the contentions urged by the Government and these appeals itself is an abuse of process. The only intention of the Government was to delay implementation of the Rules and the Orders passed by the Government itself. There is no reason, why these appeals should be kept pending.
