Status of Promotion/ Placement to the Assistant Librarians who opted UGC scale in University of Kerala

Item No.21.82 Career Advancement Scheme of UGC Regulations- Promotion/ Placement to the Assistant Librarians who opted UGC scale – status reported – Consideration of- reg: (Ad.DII)

The Syndicate held on 22.11.2019, vide item no.06.84 resolved to grant grade promotion/ placement to the Librarians as per the UGC Regulations in force from time to time, subject to the disposal of pending cases in the Hon'ble High Court of Kerala on strength of the legal opinion received from the Standing Counsel. Based on this decision, the individual files of the six incumbents who were considered as a vanishing group was processed. Among the six incumbents, Dr.Ajikumari T, Assistant Librarian, University Library was granted provisional placement to Assistant Librarian(Senior Scale) in the scale of pay Rs.15600-39100 + AGP 7000 wef 02.05.2012, under the Career Advancement Scheme of UGC Regulations 1998 (revised scheme 2006), subject to the final outcome of all pending cases, in this regard, in the Hon’ble High Court of Kerala and the decision of the Selection Committee to be consituted under the Career Advancement Scheme of UGC Regulations. When the individual files of other five incumbents viz; Dr.Hemachandran Nair G, Dr.Jalaja Kumari.C, Dr. P.K Suresh Kumar, Dr. Asha B and Smt. Sheeja B.S were submitted to the ViceChancellor for constituting Screening/ Selection Committee, the Vice-Chancellor ordered to obtain legal opinion from the Standing Counsel. It may be noted that, in due course, Dr.Hemachandran Nair.G, Smt. Sheeja B.S retired from service. The Standing Counsel, vide letter dated 06.11.2020, has opined that, “The procedure contemplated for grade promotion/ placement has to be completed in case of both the three continuing employees and the two who have superannuated. No legal embargo is caused by the pendency of the Writ Petitions, however, in the proceedings granting the benefits, it should be specifically mentioned that the same will be subject to the final outcome of the writ petitions pending before the Hon'ble High Court of Kerala.” In mean time, Dr. Asha B has again filed an IA in WPC No.7835/2020 before the Hon’ble High Court of Kerala to declare that she is entitled to get placement as Assistant Librarian (Senior Scale) under the Career Advancement Scheme of UGC Regulations wef 01.12.2010 and a further declaration that being the senior most Assistant Librarian, she is entitled to be promoted as Deputy Librarian in the vacancy that has arisen on 01.08.2019 due to the retirement of Smt. M R Maya. It may further be noted that, all these incumbents have filed cases before the High Court of Kerala, for getting placement as per relevant UGC Regulations and all the cases are pending before the High Court. Further, some of the incumbents receiving non UGC scale have also filed cases questioning granting of placement to these incumbents as per UGC Regulations and praying not to grant them promotion to the post of Deputy Librarian which is a promotion post as per the Kerala University First Ordinances, 1978. Therefore, as per orders of the Vice-Chancellor the current status on granting placement to the Assistant Librarians who opted UGC scale as per Career Advancement Scheme of UGC Regulations is placed before the Syndicate for consideration. 

Resolution of the Syndicate 

The Syndicate considered the legal opinion of the Standing Counel and RESOLVED to grant promotion under Career Advancement Scheme and consequent benefits to Assistant Librarians who opted UGC, subject to the final disposal of the writ petitions pending before the Hon’ble High Court of Kerala.
